History of Lotteries in the United States
The concept of lotteries and gambling in general was brought to America by the English in the 1600s. In the early days, gambling was considered a harmless distraction in most of the colonies, but that did not last long though as the English investors started seeing gambling as a vice, and it was banned. Lotteries however were encouraged in the colonies by the English as it generated revenue. People of Jamestown were the first ones to make use of a lottery for raising money for their colony. Seeing their success, the other 13 colonies also started funding lotteries for this purpose soon after.
Lotteries were seen as a great means of raising funds for public works, schools, bridges and roads by the legislators in the early days after independence as well. However, in 1830, Evangelical reformers started opposing the lotteries because of moral reasons. Their protests coupled with the allegations of legislative corruption and various lottery scandals resulted in the prohibition of the lotteries in all the states except for Louisiana and Delaware by 1890. The Louisiana State Lottery flourished in this era as it became the sole lottery to have remained operational while all others had been banned. This lottery was eventually prohibited in 1905 by the U.S. Supreme Court.
Although there was a ban on lotteries in America in the early 1900s, several illegal lotteries flourished during this period. However, these lotteries did not have a very good reputation among the people. It was not until 1934 that the first government-run US lottery was established. It happened in Puerto Rico. The concept of a government-run lottery became popular among the people and in the year 1964, a similar lottery was established in New Hampshire as well. The first multi-state lottery game in the United States was formed in the year 1985 and included three states: Vermont, New Hampshire, and Maine. The Powerball and Mega Millions are examples of multi-state lotteries. They were formed in the year 1988 and 1996 respectively.
Rules of Lotteries in the United States
The general rules applied to all government-run and private lotteries in the United States are as follows:
- The player buying the lottery ticket must be at least 18 years old.
- If a player wins a lottery, he must claim the prize within 180 days. After the completion of this time limit, the prize would be forfeited. This starting point of this time limit is different for draw lotteries and scratch cards.
- Lottery winners must decide how they want to receive their winnings before entering the lottery, not after winning it. The two options that are available include the cash value and the annual pay.
In addition to the abovementioned rules, the lotteries organized in the different states have their own set of rules, which vary from lottery to lottery. Varying aspects of the lotteries that make them different from one another include the ways of determining the winners, the prices of the lottery tickets and the prizes and jackpots offered. You can learn about the specific rules of a lottery from its website and understand how to participate in the lottery. In addition, you can also get additional information about the prizes and the manner in which they are awarded from the FAQ section of the lottery websites as well.
Law and Legalization of Lotteries in the United States
Lottery is defined in the law as an activity in which you have the chance to win a prize for paying a small amount of money. The prize in a lottery can range from cash and jewelry to any expensive item such as a car. The chance is determined as the odds of winning the prize while the amount of money you pay is in the form of purchasing a ticket. So, the activity is termed as a lottery if these three elements are present:
- Payment
- Chance
- Prize
The federal law states that operating a lottery over phone or mail is illegal. Moreover, there are also restrictions on the transportation or mailing of lottery tickets or lottery promotions in interstate commerce.
In addition to these legalities, there are other regulations and restrictions that are enacted by the states in which the lottery is being organized. All of the states that sponsor a lottery have their own separate lottery boards, which overlook and supervise the entire lottery operation.
Telemarketing of lotteries is another aspect that is regulated in the United States. The Federal Trade Commission (FTC) has specified some sales rules for the telemarketers of lottery tickets. They implore them to not misrepresent the chances of winnings and make certain disclosure so that the players are not kept in the dark about the particular lottery. These rules help you in putting an end to the unwanted telemarketing calls and also give the law enforcers the chance to prosecute any telemarketing companies that are involved in fraudulent practices or operate across state lines.
Winning Records in Lotteries in the United States
People have won large sums of money from lotteries in the United States. The Powerball and Mega Millions are among the two lotteries that offer the highest jackpots to the people as they are multi-state lotteries:
- The highest amount of money that has been won in a Mega Millions lottery till date is $656 million which was won by three tickets in Kansas, Illinois, and Maryland.
- The biggest win in a Powerball lottery till date is $590.5 million. The jackpot was won by 84-years-old Gloria McKenzie of Florida in 2013. She holds the world record for the most amount of money won in a lottery by a single ticket.
Taxes Applied on Lotteries in the United Stated
The lottery winnings of a person are taxed if they excess $600. In that case lottery organizers automatically notify the Internal Revenue Service (IRS) about the winning. The IRS applies a minimum withholding tax of around 25% on the winnings made from gambling that exceed $5,000. However, there are instances in which the winners have to pay extra tax on their winnings to the IRS when they are filing their returns. In addition to this tax, the states can apply taxes of their own on the winnings of the lottery players as well.
Lottery Games in Different States of the US
There are a number of lottery games available in the many states of the US. Some of the kinds of lotteries that are common in the Canada include:
- State lotteries
- Multi-state lotteries
- National lotteries
The state lotteries offer games that are exclusive to that particular state. The national lotteries offer games that are available on a national level while the multi-state lotteries provide games that are offered in multiple states. The examples of multi-state lotteries include Mega Millions and Powerball.
The different types of lotteries available in the states of the US are very popular among the people and are the best means for the government to raise money for various civic projects. Moreover, these lotteries are a form of entertainment for the people, which gives them a chance to win huge jackpots for depositing a small sum of money.
States with No Lotteries
Although lotteries are organized in majority of the American states, there are some regions that have opted to ban lotteries for various reasons and there are no government-run or private lotteries available there. These states include:
- Alabama
- Alaska
- Hawaii
- Mississippi
- Nevada
- Utah
Religious objections are the reason for the banning of lotteries in Utah, Mississippi, and Alabama while Nevada has been deprived of a state lottery because of the gambling industry there. Hawaii and Alaska are outside the contingent US. Thus, they are not losing sales to neighboring states and, for this reason, have not opted to have a state lottery.
